Article 10: Warranty
10.1.- Warranties are only applicable if the Customer has first fulfilled the payment conditions.
The Seller undertakes to ensure that the Items delivered fully comply with the Order, with
applicable legal and regulatory obligations, and with current French and European standards. The Seller
is liable for any lack of conformity existing at the time of delivery of the Items.
The Items sold are covered by the legal guarantee against hidden defects, within the meaning of Article 1641 of the Civil
Code.
In addition to these legal guarantees, a one-year commercial warranty is granted from the date of purchase,
covering all malfunctions of the Item where it has been used and maintained in accordance with
the best practices described in the user manual.
For electrical equipment such as curing lights, apex locators, endodontic motors, implantology motors, etc. The commercial warranty granted is two years. The batteries associated with this electrical equipment carry a one-year warranty, as do, where applicable, the contra-angles supplied with this electrical equipment (in the case of implantology and endodontic motors, etc.)
Claims concerning apparent defect(s) must be made within three days following
delivery......
10.2.- Under the warranty, it is specified that the Item will be returned to the Seller's workshops at Mauguio, at the Customer's expense, and that the return of the repaired Item will be at the Seller's expense.
However, as a commercial gesture, a return label via the carrier La Poste, Colissimo, may be made available to the customer. The customer may request this on our website in the "after-sales return" tab.
In the event that the malfunction does not originate from a hidden defect, a repair quote will be provided
for the Item.
If the Item was purchased (delivery date) less than one year ago, and in the event that it has been used and maintained
in accordance with the user manual, it will be covered under warranty and will either be repaired or exchanged for an
equivalent item or refunded, at the Seller's discretion.
10.3.- The Seller shall not be able to apply its warranty to the
Items in cases where the Customer has not complied with the conditions of use, in particular those mentioned in
the user manual and, where applicable, optimal storage conditions.
Furthermore, the following are excluded from any warranty:
a. Normal wear and tear of the equipment.
b. Defects due to use or maintenance, negligence.
c. Damage caused by mishandling, misuse, or abnormal use.
d. Spare parts or accessories whose replacement results from normal wear and tear, or from routine maintenance operations, in particular: batteries, cells, rotor, bearings.
e. Transport and modification costs for the Item, in the event of a manufacturer recall due to a production defect.
f. Damage caused by an external event (lightning, water damage, etc.).
g. Work carried out on the Item by a person not authorised by the manufacturer's after-sales service.
h. Harmful consequences arising from the use of non-original accessories or spare parts, or from the dismantling or modification of the Item.
The Seller's commitment ends in the event of failure by the manufacturer to supply spare
parts and accessories.
In all cases, the Seller cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt. The Seller's liability is systematically limited to the value of the Item in question, at its value on the date of sale, with no possibility of recourse against the company that produced the product. All claims, requests for exchange
or refund must be made by recorded delivery with acknowledgement of receipt to the following address: DFC INSTRUMENTS,
IN PRACTICE:
If you have a problem with a piece of equipment or one of its components / accessories purchased from us ;
You send the equipment back to us in a tracked parcel, well protected against impacts, by post or other carriers, to our address: DFC Instruments, 45 rue Merlot, 34130 Mauguio, or submit a return label request via La Poste in the "After-Sales Returns" tab.
Include in the parcel the name of the Practitioner and their address. If you have the purchase invoice that is even better, but not mandatory.
If the malfunction is due to a hidden defect in the device, it will be repaired or replaced by an equivalent product and returned to you (at our expense).
In the event that the malfunction is not due to a hidden defect, or the equipment is outside the commercial warranty period, you will be provided with a repair estimate for the equipment.
If the equipment has been purchased (delivery date) less than one year ago (two years for non-rotary electronic equipment, see our Terms and Conditions), and provided it has been used and maintained in accordance with the user manual, the equipment will be covered by the warranty, and will either be repaired, exchanged for an equivalent product, or refunded at the discretion of DFC Instruments.
